On an H1-B visa, US employers can hire foreign professional employees who have at least a four year college degree (or the equivalent) and will work in a specialty position. A specialty occupation is one that requires theoretical and practical application of a body of specialized knowledge along with at least a bachelor’s degree or its equivalent. Specialty occupations include professions within architecture, engineering, mathematics, physical sciences, social sciences, medicine and health, education, business specialties, accounting, law, theology and the arts.
The law currently limits the number of foreign nationals who may be issued a visa or otherwise provided H-1B status to 65,000 (plus an additional 20,000 H1-Bs for foreign nationals who graduate with an American university or college degree), although in past years this has been more than doubled to accommodate the needs of various industries. According to officials from industry and labor groups, the high demand for H-1B visas means that proposals to raise the H-1B cap are likely to continue to be introduced in Congress in coming years.
